
This Division is responsible filing pleadings in the following types of cases:
Filing fee is $82.50 plus $25.00 for each Sheriff’s Entry of Service and can be payable in one check. However, if a service is being perfected in another county, the service fee must be payable to the appropriate Sheriff’s office. Service by a Process Server must be pre-approved by court order be service is attempted.
Q: Where do I get the forms to file for an uncontested divorce?
A. We do not have forms in White County. We strongly urge you to contact an attorney and have the forms prepared by them.
Q: What forms are needed to file for a divorce?
A. You need a Complaint/Petition, Verification, Acknowledgment of Service, Settlement agreement,
and if children are involved, a Child Support worksheet and Parenting Plan.
Q: How long from the date of filing will I be divorced?
A. It will be a minimum of 45 days plus the next available court date.
Q: What qualifies me for a TPO?
A. There must be a family relationship with family violence or the threat
of inflicting bodily harm. The Plaintiff must file in the county where the
Defendant resides.
Q: What is required in a garnishment?
A. You must prepare a summons, affidavit, provide proof of Judgment (FIFA or
judgment), and seven (7) Answer forms for continuing garnishments. You must send
a Disbursement Order before funds will be released from the court registry.
